The US Department of Justice has announced that federal employees can now download and install TikTok on government-issued devices, effectively lifting the controversial ban that has been in place since 2022. The reversal comes after TikTok’s US operations were restructured into a new joint venture that the DOJ says no longer poses the national security risks that prompted the original prohibition.

Background of the Ban

TikTok was first outlawed on almost all devices issued by the US federal government in 2022 due to national security concerns. At the time, FBI Director Chris Wray warned that China could use the app to collect data on users through its parent company ByteDance. The ban covered approximately 4.5 million federal employees across dozens of agencies, barring them from using the popular short-video platform on work-issued phones and computers.

In 2024, the US House of Representatives went a step further, passing a bill that would have banned TikTok nationwide unless ByteDance divested its US operations entirely. The legislation reflected growing bipartisan concern over data security and potential foreign influence through the platform.

The TikTok USDS Joint Venture

A deal for TikTok’s US business was finalized in January 2026, leading to the creation of a new entity called TikTok USDS Joint Venture. Under the terms of the agreement, ByteDance retained an approximately 20 percent stake in the new business, while the majority is controlled by a group of non-Chinese investors, including Oracle.

When the deal was announced, TikTok stated that the new venture would protect American users’ data using Oracle’s secure US cloud environment. The company also confirmed that the US entity would train TikTok’s algorithm on data from people within the United States, while still providing access to international content.

What the Justice Department Said

In its official announcement, the DOJ explained its reasoning clearly:

“The version of TikTok operated by the TikTok US Data Security Joint Venture does not fall within this prohibition because the Joint Venture functions independently of ByteDance, is majority-owned by American investors, and has revised the content recommendation algorithm and cybersecurity program originally developed by ByteDance to insulate federal government information against the concerning security features that initially motivated the prohibition.”

This effectively means the DOJ’s Office of Legal Counsel determined that the restructured TikTok meets the security standards necessary to be permitted on federal devices.

Agency-Level Discretion Remains

Despite the DOJ’s decision, individual federal agencies retain the authority to decide whether to allow TikTok on their employees’ devices. The DOJ noted that agencies may still choose to ban the app “for workforce management reasons, such as promoting employee productivity.”

This means that while the federal-level prohibition has been lifted, some departments may continue their own internal bans depending on their specific operational requirements and security assessments.
